After losing another attempt in Cook County, Ill., circuit court Tuesday to get a stay of a 30-day suspension, Churchill Downs-based jockey Jamie Theriot has decided to drop his appeal of the ban, his agent, Fred Aime, said Thursday morning. Theriot was suspended 30 days on May 25 by stewards at Arlington Park for his ride aboard Sky Mom in the Arlington Matron on May 23. Theriot, the stewards ruled, "jostled" Born to Be when tried to go through a hole at the top of the homestretch. Born to Be careened outward, clipped heels, and went down, rolling over onto and seriously injuring jockey Rene Douglas. Sky Mom was disqualified from fifth to last. Theriot began serving his suspension last Saturday, and a legal petition filed Tuesday seeking an emergency hearing on a preliminary injunction against the ban was denied. "We're going to miss a few days, but we're just going to bite the bullet," Aime said.
