Jockey Antonio Fresu, second in the Del Mar standings through Sunday, was sanctioned for a third violation of excessive use of the whip in the last week on Monday and has been suspended 32 calendar days from Saturday through Oct. 9. Fresu received two seven-day penalties, one 15-day penalty, and three single-day penalties, one for each infraction. The timeline regarding the penalties was originally more severe. The terms of two of the three penalties were amended on Monday to cover calendar days and not racing days. In rulings published by Del Mar stewards last week on the first two penalties, Fresu was originally suspended seven racing days for each infraction, which would have stretched the term of those suspensions through Oct. 9. The infractions occurred in races at Del Mar on Aug. 27 and Aug. 31. Those rulings were amended by Del Mar stewards Luis Jauregui, Kim Sawyer, and Rich Williams on Monday to cover calendar days, following rules enacted earlier this year by the Horseracing Integrity and Safety Alliance. On Monday, Fresu was penalized for a third infraction for excessive use of the whip aboard Lunar Impact in the first race at Del Mar on Saturday. Lunar Impact, who won a maiden race on turf by a head, was struck seven times by Fresu, one above the permitted limit, according to a ruling published on Monday. Because Fresu’s infraction on Lunar Impact was the rider’s sixth penalty for excessive use of the whip in the last six months, he was suspended 15 calendar days – from Sept. 25 to Oct. 9 - and fined $492. Fresu was fined $748 combined for the first two penalties. For the two seven-day penalties, Fresu will be allowed to ride designated races from Saturday through Sept. 23. During the 15-day suspension, Fresu will be unable to ride in any races. Designated races are typically any stakes at Los Alamitos, and graded stakes at Del Mar and Santa Anita. The dates of the two seven-day suspensions cover the final two days of the Del Mar summer meeting, which ends on Sunday, and most of the two-week Los Alamitos September meeting. The 15-day penalty covers the final day at Los Alamitos and the first two weeks of the Santa Anita autumn meeting, which begins on Sept. 29. From Sept. 29 through Oct. 8, Santa Anita has scheduled 14 stakes designed as preps for Breeders’ Cup races on Nov. 3-4. Tom Knust, Fresu’s agent, said on Monday afternoon that Fresu plans to appeal the second seven-day suspension on the basis that the stewards incorrectly interpreted the rules regarding excessive use of the whip. The appeals will be submitted to HISA officials. Fresu, 31, moved from Dubai to California in April and is in the midst of his best meeting at Del Mar this summer.
